A 55 gallon drum of used oil and a 55 gallon drum of oily solids/debris were observed without a <br /> hazardous property marked. A white plastic bucket of oily water from scale bin hydraulic pump <br /> containment was observed with only the contents listed on the container. All hazardous waste <br /> containers shall be marked with the following information: <br /> 1. the words "Hazardous Waste" <br /> 2. name and address of generator <br /> 3. hazardous properties (flammable, corrosive, reactive, toxic) <br /> 4. physical state (liquid, solid) <br /> 5. composition (contents) <br /> 6. accumulation start date <br /> Immediately label these containers and ensure that all hazardous waste containers are marked with all <br /> the required information. The used oil and oily solids/debris labels were corrected at the time of <br /> inspection. <br /> REPEAT VIOLATION <br /> Notice to Comply - Minor violations: (7, 44) <br /> 7. Metal fines generated from the band saw are being recycled as scrap metal without first determining <br /> particle size or hazardous properties. COD waste (chromic acid, sulfuric acid) are being sent back to the <br /> manufacturer for recycling. Any person who generates a waste shall determine if the waste is a <br /> hazardous waste. Immediately stop recycling metal fines and COD waste, make a hazardous waste <br /> determination for the band saw and laboratory waste, and manage it according the Title 22 hazardous <br /> waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is <br /> determined to be a hazardous waste. Submit a statement and supporting documentation explaining how <br /> these wastes were managed by April 14, 2011. <br /> 44. On March 4, 2011 the monthly tank inspection noted acid in the secondary containment for the <br /> sulfuric acid tank. Clean up was observed in progress at the time of the EHD inspection. According to <br /> the facility contact, the contingency plan should have been implemented. The provisions of the <br /> contingency plan shall be carried out immediately whenever there is a fire, explosion, or release of <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($1221. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector.
