1 defendants' BOAT REPAIR SERVICE activities in the County of San Joaquin and elsewhere in <br /> 2 the State of California. <br /> 3 3. Defendants, in the course of defendants' BOAT REPAIR SERVICE activities, are <br /> 4 pursuant to Health and Safety Code, Chapter 6.5 hereby permanently enjoined from: <br /> 5 a. Violation of Chapter 6.5 of the Health and Safety Code. <br /> 6 4. Defendants, in the course of defendants' BOAT REPAIR SERVICE activities, are <br /> 7 pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 8 a. Violation of Chapter 6.5, of the Health and Safety Code described in <br /> 9 paragraph 3 above. <br /> 10 5. Defendants have provided to the San Joaquin County District Attorney proof that <br /> 11 Defendants, in the course of defendants' BOAT REPAIR SERVICE activities, since the <br /> 12 investigation began, expended the sum of THIRTEEN THOUSAND FOUR HUNDRED AND <br /> 13 FIFTEEN DOLLARS ($13,415.00), in order to come into compliance with Chapter 6.5 of the <br /> 14 Health and Safety Code, as described above in paragraph 3 and 4. <br /> 15 6. Defendant shall pay to plaintiff the sum of TEN THOUSAND DOLLARS <br /> 16 ($10,000.00), as and for civil penalties, pursuant to Business and Professions Code §17200 et <br /> 17 seq.. However, it is stipulated by all parties that the entire TEN THOUSAND DOLLARS <br /> 18 ($10,000.00), in civil penalties shall be stayed for three (3) years on condition that the following <br /> 19 term is met: <br /> 20 a. Defendant will not dispose hazardous waste in violation of Health and <br /> 21 Safety Code §25189.5. <br /> 22 7. The TEN THOUSAND DOLLARS ($10,000.00), described in paragraph 6 <br /> 23 above, shall immediately become due if the San Joaquin County District Attorney files <br /> 24 declarations that defendant violated Heath and Safety Code section 25189.5 prior to the <br /> 25 expiration of the three year period described in paragraph 6 above. If the conditions listed in <br /> 26 paragraph 6 above are met, then the $10,000.00 in stayed penalties shall be permanently lifted on <br /> 27 September 1, 2008. <br /> 28 <br />
