MAGDICH <br />Deputy City Attorney <br />RECEIVED <br />Nov 15 201, <br />EN PERMRES FMCCF.S IIEALTM <br />Former Lodi Valley Towing Products Plant Manager at the above address, Dennis Bour, <br />informed Rob Lechner of the Lodi Electric Utility that Valley Towing left a number of <br />unidentified hazardous chemicals behind at the above location when it vacated the <br />premises earlier this week. Mr. Bour indicated that the City may want to "keep an eye" <br />on the chemicals as a number of them need maintenance to avoid their release into the <br />environment. As you know, the City of Lodi is not an owner or operator of the above <br />location. <br />This letter will serve as notice that the City has no legal access to the property to provide <br />the suggested maintenance, nor the technical expertise to analyze and care for an <br />unknown suite of chemicals. Indeed the City has no legal duty to do so and is quite <br />stunned your firm would abandon them. Your abandonment is complicated by the fact <br />that you terminated electric, water, and wastewater service at the location where the <br />allegedly toxic materials were abandoned. <br />This letter will also serve as notice that the City cannot take custody of the materials. <br />Moreover, the City demands that Valley Towing Products immediately secure and <br />dispose of these materials. We have copied the appropriate environmental health and <br />regulatory authorities and the property owner, Thule Hitch Systems, Inc. to ensure <br />compliance with your legal and ethical obligations. <br />ere] <br />C� <br />D.
