Box 15002 <br />Sacramento, Calif. 95851 <br />(916) 484-3011 <br />Re: Billing Statement for Underground Fuel Storage Tanks <br />Teichert Land Company <br />Dear Mr. Favila: <br />a t <br />�; <br />MAR 4 T131 <br />ENVIRONMENTAL HEALTH <br />PERMIT/SERVICES <br />Please reference your billing for a permit to operate an underground tank facility at <br />20913 East Highway 12, Clements, CA. <br />Since discovery of the tank in 1990 we have tried to permit its removal. Your <br />Environmental Health Department was approached by our agent Elder Engineering for <br />necessary permits. Upon learning that you considered the tank a non agricultural fuel tank <br />and intended to charge back fees of $806.00 for the period 1986-1990. I have attempted to <br />convey to your staff that the fuel tank on this working farm should be classified as an <br />agricultural tank. I visited you and your staff on January 18, 1991 and stated the tank was <br />located on an agricultural parcel producing in excess of $1,000/year of row crops. A <br />Teichert Land Company Officer sent your staff a letter certifying the agricultural land usage. <br />Your staff replied this was insufficient proof and that they needed to see copies of receipts <br />for crop sales. Currently the property is leased to William Reichmuth who farms the land. <br />Prior to 1990 the property was subleased for farming purposes by Rozzoni Ranch. Both <br />members of the Rozzoni family died in 1990 and while we are not privy to their sublease <br />records. I have asked their sublessee to share his old receipts. I have included copies of <br />checks from Rozzoni Ranch to Teichert Land Company indicating over $3000/yr lease <br />payments and copies of information from Mr. Reichmuth supporting the agricultural usage. <br />Mr Reichmuth has no obligation to us to retrieve records but he did furnish records for the <br />last year. I have since been asked by you to furnish "proof' for each year in question. <br />I feel that we are being asked to go through an unusual amount of effort to prove the <br />obvious. The land has been farmed continuously through the 1980's production exceeds <br />$1000/year, and I believe the tank was a agricultural fuel tank. <br />I am including a check for fees for 1986 through 1991, totaling $1032.00 to expedite the <br />removal process and to avoid any penalties, but formally protest these fees. <br />
