EHD records show that <br /> on March 11, 2008, a certified letter was sent to the above address notifying you of new owner UST <br /> requirements (California Health and Safety Code Section 25284) and requesting that you submit the required <br /> forms to the EHD. As of this date, the EHD has not received these documents. See the enclosed letter for the <br /> new owner requirements. <br /> On June 3, 2008, the EHD was notified by the property owner that the USTs at the site were emptied of fuel two <br /> weeks ago. Send an application for temporary or permanent tank closure to the EHD within 90 days of <br /> cessation of hazardous substance storage pursuant to California Code of Regulations, Title 23 Section 2670. <br /> On January 25, 2008, invoices were mailed out for the 2008 UST operating fees as well as other associated fees. <br /> All fees are due and payable at this time. As of this date, the EHD has not received payment for these fees. <br /> Violations: <br /> California Health and Safety Code Section 25284(a)(1)—Except as provided in subdivision(c),no person may <br /> own or operate an underground storage tank unless a permit for its operation has been issued by the local agency <br /> to the owner or operator of the tank. , <br /> California Health and Safety Code Section 25284(c)—Any person assuming ownership of an underground , <br /> storage tank used for the storage of hazardous substances for which a valid operating permit has been issued <br /> shall have 30 days from the date of assumption of ownership to apply for an operating permit pursuant to <br /> Section 25286 or, if accepting a transferred permit, shall submit to the local agency the completed form <br /> accepting the obligations of the transferred permit. <br /> California Health and Safety Code Section 25299(x)—Any operator of an underground tank system shall be <br /> liable for a civil penalty of not less than five hundred dollars($500)or more than five thousand dollars($5,000) <br /> for each underground storage tank for each day of violation for any of the following violations: (1)-Operating an <br /> underground tank system which has not been issued a permit, in violation of this chapter. <br /> Page 1 of 2 <br />
