January 25, 1999 <br /> The Closure Plan arrived today without fees. Briggs called and spoke to Mrs. Marsili. Briggs <br /> explained how important the plan was and stated that it could not be reviewed until tank closure <br /> fees were received. Briggs told Mrs. Marsili the tank is considered illegally abandoned. <br /> February 2, 1999 <br /> Closure Plan fees were received. <br /> February 8, 1999 <br /> Briggs requested that Trevena document his December 1998 conversation with Eugene Marsili. <br /> Trevena made an entry on the Narrative sheet for December 1998. <br /> February 22, 1999 <br /> Briggs reviewed the Closure Plan for UST #1 — 4000 gallon diesel tank, and reviewed the file to <br /> determine the diesel tank history. (There is no monitoring information in the file). This tank was <br /> never precision tested. The Closure Plan lacks: 1) Plot Plan with septic tank, leach fields, water <br /> wells and building locations, 2) Name of soil sampler, 3) Authorization to Release with laboratory <br /> name, 4) Completed Page #10 UST Tracking Record, 5) Site Health & Safety Plan, and 6) A <br /> completed backfill certificate. As a result, the Closure Plan was incomplete. <br /> Briggs called the owner, Eugene Marsili and explained his options. He needed to complete the <br /> Health & Safety Plan. He could also triple rinse the UST or have the tank hauled as hazardous. <br /> Briggs left the incomplete Closure Plan and site Safety Plan (example) downstairs at the EHD <br /> counter for him to pickup. <br /> March 3, 1999 <br /> Briggs received the completed Closure Plan. <br /> March 5, 1999 <br /> Briggs conditionally approved the Closure Plan. Thorpe oil will decontaminate/haul the tank. <br /> March 10, 1999 <br /> Briggs went out to do an inspection for tank closure and laboratory soil sampling. Briggs spent 1 <br /> hour traveling, and 1 hour awaiting soil sampler on site. The soil sampler did not come so Briggs <br /> left and awaited a call to return for sampling. <br /> Briggs received a call from Eugene Marsili requesting she return to M & M Harvesting to witness <br /> sampling under the east and west end of the tank. The soil sampler arrived late. Briggs witnessed <br /> sampling under the east and west end of the tank and stockpile. No piping samples were required <br /> as the dispenser is located over the tank. Briggs spent 1 hour for the inspection and 1 hour <br /> traveling. <br /> As per Eugene Marsili, Thorpe Oil is to rinse and haul tank from site tomorrow. <br /> April 22, 1999 <br /> Briggs reviewed the file for closure information. The tank tracking record, rinsate manifest, soil <br /> sample results, and Tank Certification had not been received. <br /> Briggs called M & M and spoke to Eugene Marsili. He stated he would send the information ASAP. <br /> Briggs called Thorpe Oil. As per Rich Thorpe, he was holding the rinsate manifest and tank tracking <br /> paperwork until he got paid. <br /> This site was out of compliance. The closure was incomplete. <br /> August 17, 1999 <br /> Briggs received incomplete laboratory soil sample results from Marsili (lacking east end of the tank <br /> sample results). Briggs called Marsili Brothers and was told to call back later. As per Doug Wilson, <br /> proceed with the D. A. case. <br />
