It is my
Understanding that you contest Environmental Health Division, San Joaquin County Public Health
Services' requirement for a description of the covering for the soil stockpile and the final soil
destination location in the event that contaminated soil is involved. Specifically you request the
specific statutory authority that allows the County to require this information in an underground storage
tank removal plan.
San Joaquin County, Public Heath Services, Environmental Health Division is the local
enforcement agency responsible for enforcing and regulating the state statutes and regulations
concerning the removal of underground storage tanks and the clean-up and remediation associated with
such removal. Prior to removing an underground storage tank a closure plan 1' st be submitted to the
local agency for approval. (Cal. Admin. Code, tit. 23, § 2670, subd. (f).) The local enforcement
agencies have been delegated the authority to adopt and enforce local standards of performance which
may be more stringent than the state regulations. (Health & Saf. Code, § 25299.2.)
San Joaquin County, Public Health Services, Environmental Health Division has set local
standards of performance which are applied to all tank removal projects. These standards may be more
stringent than the state standards or other local agencies. San Joaquin County currently requires that
the initial work plan identify the final destination place for any soil, if contaminated.
