Miner <br />In response to your letter of May 22, 2001 the conditions of the permit have not changed and the <br />requirement to have a plan to remove contaminated soil must be part of the application. If you do <br />not want to contract to do this work for Mr. Singh, please have Mr. Singh provide a statement that <br />he will provide another contractor and proper location for the soil disposal and his permit <br />application can be approved. I have enclosed a copy of the letter from San Joaquin County <br />Councils Office to you concerning the last time this issue came up. Note that the contaminated <br />soil removal requirement under Health and Safety Code, Section 25299.2(a) has not changed and <br />is included in the permit requirements to prevent possible air pollution or other public nuisances <br />from occurring if gross contamination is found during tank removals. The EHD is responsible to <br />protect the public and the environment from nuisances involved in the removal of underground <br />tanks. The application requirement also provides for certain exemptions for disposal of soil from <br />tank removals, if a work plan exists and is approved by a public agency. If an approved work <br />plan did not exist, the Owner Mr. Singh could incur additional costs of disposal of soils. <br />Please note that all time used to complete an acceptable application for permit is charged to the <br />permit including responding to correspondence from the contractor.
