Therefore, it is being proposed that <br /> the claim be removed from the Priority List based an the <br /> following reason(s) : <br /> (1) • On June 10, 1992 Pete Giambanco, Sr. (Giambanco) was <br /> required to attend an administrative hearing at the San <br /> Joaquin County Environmental Health Division (County) <br /> offices during which he agreed to provide a temporary <br /> closure plan or permanent closure plan within 30 days. This <br /> hearing was necessitated by the lapse of deadlines on <br /> October 25, 1991, and January 24 , 1992 for submittal of a <br /> closure plan. <br /> • By July 13 , 1992 the County had not received <br /> Giambanco's closure plan which resulted in the preparation <br /> of a District Attorney's case. <br /> • On August 19 , 1992 Giambanco was sent a directive to <br /> provide the overdue free product removal plan immediately. <br /> 4 On September 9, 1992 the City of Stockton filed a <br /> violation notice. <br /> • On September 18, 1992 the County called Giambanco and <br /> explained the minimum requirements for compliance: 1) free <br /> product removal; 2) tank closure plan; 3) continuous <br /> quarterly monitoring. On October 12 , 1992 these items were <br /> still not corrected. <br /> ® On October 22 , 1992 the County received a letter from <br /> Giambanco stating that he would submit the closure plan no <br /> later than October 30, 1992 . <br /> • On November 6, 1992 Giambanco told the County he would <br /> send the closure plan by November 9 , 1992 . <br />
