Page 2 • Wright does not include any permit fees beyond those named specifically in this proposal (See stipulations); • Enhanced vapor recovery testing required by APCD. • Any delay associated with encountering subsurface contamination in soil during the course of the UST repair work; (Additional labor, materials and equipment for standby will be charged for as per our Standard Rate Schedule) • Pea gravel that results in undermining of adjacent concrete or subsidence of any kind in tank excavation sidewalis. • Containers, labeling, transportation and/or disposal of any solid or liquid waste that is, or appears to be, contaminated by any regulated materials or waste. Additional time associated with removal and replacement of spill buckets with separate drain lines. Stipulations: • The local Department of Environmental Health, Fire Department and Air Pollution Control District all may inspect the work that Wright completes; however, the owner should note that testing and inspection work is poorly defined within the regulations, and testing is left to interpretation of oversight agencies. All estimated costs are subject to change based upon any particular inspector on any particular site. Wright cannot control all variables or guarantee that there will not be unforeseen additional regulatory expenses, administrative expenses, and/or expenses for remobilization or labor downtime. The price quoted in this proposal is limited to only those items named in this proposal_ • Any delays caused by the client, client's employees, client's vendors, client's customers, or regulatory agencies, will be charged at time and material rates as per the attached rate schedule; • Client is responsible for identifying any buried utilities of any kind (conduits, conductors, plumbing, etc.)in the work area and indemnifies Wright from any responsibilities for damages for such utilities not located; • Client will allow Wright Environmental Services access to the worksite as well as electricity, water and sanitary facilities during the duration of this project; • No fuel deliveries allowed during EVR upgrade work (approximately 2-3 days). • Client must complete the requirements and conditions listed in the "Authority to Construct" (ATC)within the time periods therein specified. Satisfactory completion is necessary for the client to obtain a "Permit to Operate" and then he is in compliance. Client must contact an appropriate third party testing contractor and ensure completion of the listed tests within 45 days of Wright's completing the work described here. Wright will notify in writing the APCD upon completion. During the 45-day period and 3'd party testing any repairs required to pass would be provided by Wright on a time and materials basis. All testing and additional repairs must be completed within the specified 45-day period; • Modifications to the UST system, which are not specifically named and included in this contract, will be completed by separate contract or named and allowed by the client in a change order; • Any risers extending up from tank are spaced far enough apart to allow installation of retrofit buckets without modification.
