BJJ COMPANY LLC � c2o9, 94,-8361 <br /> LLC K ` ' RECEIVED <br /> I ,� <br /> JUN 7 2013 <br /> ENVSflaNMENTALHEALTH <br /> Ms. Stacy Rivera REHS PERWISERVICES <br /> SJC Environmental Health Department <br /> 1868 East Hazelton Avenue, <br /> Stockton,CA, 95205-6232 <br /> Ms. Rivera, <br /> In response to the Underground Storage Tank Inspection on May 22, 2013, BJJ has taken the following <br /> corrective actions in response to the minor violations observed during the inspection. <br /> Minor Violation#1: <br /> Annual monitoring system certification, leak detector testing, and spill container testing was performed on <br /> May 2, 2012 and the test report was submitted to the EHD on June 20, 2012, more than 30 days after <br /> testing. A copy of the test report must be submitted within 30 days of the tests. <br /> BJJ Company's Corrective Action: <br /> BJJ Company, LLC (BJJ) contracts out their Designated Operator duties to Afforda Test. Afforda Test <br /> performed the May 2, 2012 Annual Monitoring System Certification test and was also delegated to report <br /> and submit the report on BJJ's behalf. BJJ was unaware of the late submission of the 2012 Annual <br /> Monitoring System report. Upon being notified of the late submission during the May 22, 2013 inspection, <br /> BJJ questioned Afforda Test in regards to the late submission. Afforda Test admitted error in submitting <br /> the report late, however, Afforda Test disputes the date the County states they received the letter. <br /> Afforda Test claims the report was mailed 6/6/12. <br /> In response to BJJ's inquiry, Afforda Test stated the following correction item... <br /> "We are working toward installing a program on our technicians laptops in which printouts can be <br /> downloaded rather than printed out and then snail mailed to the regulatory agency. This would get <br /> results to their office without any interim time with the post office and would give us an exact time that <br /> they were sent." <br /> Minor Violation#2: <br /> A new designated operator, Ed Steams, was hired and notification was not provided to the EHD within 30 <br /> days of the change. Mr. Steams conducted the November 2, 2012 monthly inspection, but the updated <br /> statement of designated operator was submitted on May 13, 2013. Any changes shall be reported to the <br /> EHD within 30 days. <br /> BJJ Company's Corrective Action: <br /> BJJ was unaware that the new designated operator update was not provided by its Designated Operator <br /> contractor, Afforda Test.
