RESOLlJTION NO. 16-4089 <br />A RESOLUTION OF THE LATHROP CITY COUNCIL TO AUTHORIZE CITY STAFF <br />TO SUBMIT AN APPLICATION FOR ANNEXATION OF THE LATHROP PILOT <br />FLYING J PR07ECT AREA (ANX-15-55) <br />WHEREAB, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider Annexation of the 24.5 acre Lathrop Pilot Flying ] <br />project and a 3.15 acres of adjoining land, 27.65 acres total; and <br />WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider the Final Environmental Impact Report (FEIR), <br />CEQA Findings of Fact, Statement of Overriding Considerations and Mitigation <br />Measures/Monitoring Reporting Plan (SCH #2015102062) prepared forthe Lathrop Pilot <br />Flying J project and associated entitlements, and associated entitlements, including <br />Zoning Map Amendment, Annexation for a 27.65-acre project area of which 3.15 acres <br />are made up of contiguous, Conditional Use Permit, Site Plan Review; and <br />WHEREAS, prior to recommending adoption of a Resolution related to the <br />Annexation of the Lathrop Pilot Flying J project, the Planning Commission independently <br />reviewed and considered all written evidence and oral testimony presented to date, City <br />staff reports and all information received at the duly noticed public hearing, all of these <br />documents and evidence of which are incorporated herein by reference; and <br />WHEREAS, the Planning Commission found the 27.65 acre Annexation to be <br />consistent with the Lathrop General Plan; and <br />WHEREAS, the City of Lathrop Planning Commission held a duly noticed public <br />hearing on May 11, 2016, to consider the Lathrop Pilot Flying J Annexation No. 15-55 <br />and after taking and considering all public testimony adopted Resolution No. 16-07 <br />recommending City Council approval of the Pilot Flying J Annexation; and <br />WHEREAS, the City of Lathrop City Council held a duly noticed public hearing on <br />June 6, Z016, to consider the Environmental Impact Report (EIR), CEQA Findings of <br />Fact, Statement of Overriding Considerations and M’itigation Measures/Monitoring <br />Reporting Plan (SCH #2015102062) prepared for the Lathrop Pilot Flying J Travel <br />Center and associated entitlements, including Zoning Map Amendment, Annexation for <br />a 27.65-acre project area of which 3.15 acres are made up of contiguous properties, <br />Conditional Use Permit, Site Plan Review; and <br />WHEREAS, prior to recommending adoption of the Annexation (Attachment J to <br />the City Council Staff Report of ]une 6, 2016 and incorporated herein by reference) <br />relating to the Lathrop Pilot Flying J Annexation Area, the City Council has <br />independently reviewed and considered all written evidence and oral testimony <br />presented to date, City staff reports and all information received at the duly noticed <br />public hearing, all of these documents and evidence of which are incorporated herein by <br />reference; and <br />Resolution No. 16-4089 Page 1
