ORDINANCE NO. 16-357 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />LATHROP AMENDING THE LATHROP ZONING MAP TO PRE-ZONE <br />APPROXIMATELY 27.65 ACRES ON THE NORTH SIDE OF ROTH ROAD, EAST <br />OF INTERSTATE 5, TO HIGHWAY COMMERCIAL (CH) RELATED TO THE , <br />LATHROP PILOT FLYING .7 PR07ECT ARE 4 (PRZ-15-54) <br />WHEREAS, the City of Lathrop Planning Commission held duly noticed public <br />hearings on May 11, 2016, to consider the Final Environmental Impact Report <br />FEIR), CEQA Findings of Fact, Statement of Overriding Considerations and <br />Mitigation Measures/Monitoring Reporting Plan (SCH #2015102062) prepared for <br />the Lathrop Pilot Flying J project and associated entitlements, and associated <br />entitlements, including Zoning Map Amendment, Annexation for a 27.65-acre <br />project area of which 3.15 acres are made up of contiguous, Conditional Use <br />Permit, Site Plan Review; and <br />WHEREAS, the City of Lathrop City Council held a duly noticed public <br />hearing on ]une 6, 2016, to consider the Environmental Impact Report (EIR), CEQA <br />Findings of Fact, Statement of Overriding Considerations and Mitigation <br />Measures/Monitoring Reporting Plan (SCH #2015102062) prepared for the Lathrop <br />Pilot Flying J project; and <br />WHEREAS, prior to approving Zoning Map Amendments to the official <br />Lathrop Zoning Map relating to the Lathrop Pilot Flying J project, the City Council <br />adopted a Resolution approving and certifying the Environmental Impact Report <br />prepared for the Lathrop Pilot Flying J project and associated entitlements, subject <br />to the Mitigation Monitoring Reporting Plan" (MMRP) and based on the CEQA <br />Findings and Statement of Overriding Considerations", incorporated herein by <br />reference; and <br />WHEREAS, the Lathrop Pilot Flying J project area requires a zoning map <br />change to Highway Commercial (CH) in order to be consistent with and implement <br />the Lathrop General Plan; and <br />WHEREAS, the City Council has independently reviewed and considered all <br />written evidence and oral testimony presented to date, including the Environmental <br />Impact Report (consisting of the DEIR and FEIR) prepared for the Lathrop Pilot <br />Flying ] project and associated entitlements, City staff reports and all information <br />received (including late communications) at the duly noticed public hearings, all of <br />these documents and evidence of which are incorporated herein by reference; and <br />WHEREAS, the City Council finds the Highway Commercial (CH) zoning of <br />the Lathrop Pilot Flying J plan area to be consistent with the intent and purposes of <br />the Lathrop General Plan; and <br />Ordinance No. 16-357
