ARCO Products Con.,.ny to Division of Atlantic Richfield Company FACILITY NO. 09600 AMENDMENT TO LESSEE PMPA FRANCHISE AGREEMENT/DEALER/PREMISES LEASE OPERATION OF UNDERGROUND STORAGE TANKS CALIFORNIA This Amendment, dated , 19_, is attached to, incorporated in and made a part of the Lessee PMPA franchise Agreement/Dealer/Premises Lease ("PMPA Agreement"), in effect as of the date of this Amendment or, if applicable, to become effective concurrently with this Amendment, between Atlantic Richfield Company, a Delaware Corporation, through its division ARCO Product Company, ("ARCO"), and PRESTIGE STATIONS INC. #09600 ("Franchisee"), covering premises located at 1250 Wilson Way, Stockton, California 95202. In return for good and valuable consideration, each party's receipt of which is hereby acknowledged, the parties agree as follows: 1. The parties have entered into this Amendment in accordance with legal requirements imposed on ARCO and Franchisee concerning operation of the underground storage tanks at the above- referenced location. 2. ARCO has provided Franchisee a copy of: (a) California Health and Safety Code Section 25299 or an approved summary concerning civil and criminal penalties for violating terms of any permit to operate these underground storage tanks and relevant statutory and regulatory requirements; (b) the following listed documents, a copy of which is attached and initiated by Franchisee: Monitoring and Response Plan X and SC with Attachments 3. Where ARCO has provided Franchisee with a copy of the permit to operate the underground storage tanks, Franchisee has read and understood its responsibilities as operator under the permit and agrees to comply with each of the provisions of the permit. Irrespective of whether Franchisee has received and reviewed a copy of the underground storage tank operating permit, Franchisee hereby expressly agrees to do the following (a) monitor the underground tanks as required by law; (b) maintain all required records and make such records available to the federal, state, and local government agencies and to ARCO at all reasonable times; (c) follow all reporting procedures as required by law; (d) mail, when submitted to, ARCO, at the address specified in paragraph 1 of the PMPA Franchise Agreement/Dealer/Premises Lease, a copy of all reports submitted to overnment agencies, (e) follow all operating procedures specified by ARCO; CA(1/92) 1 of 2 PAR38W
