6 . Owner-Operator and its contractors, subcontractors, and <br /> any other third party involved, and each and all of them, agree to <br /> hold Contractor free and harmless from any and all liability, <br /> loss, cost, expense, or damage, including consequential damages, <br /> in any way arising in any way in connection with this Agreement or <br /> any attempted corrective or remedial action undertaken by <br /> Owner-Operator or its contractors, subcontractors, or any other <br /> third party, except only for any liability which may arise from <br /> Contractor' s sole negligence or willful misconduct. <br /> 7 . Any tank to be tested by Contractor must be filled by <br /> Owner-Operator to capacity plus four (4) inches into the <br /> respective fillpiping, and allowed to remain static for a minimum <br /> of three (3) hours prior to Contractors arrival. Owner-Operator <br /> must provide an additional twenty (20) gallons in a separate <br /> container for standpipe fill or makeup purposes. If any line <br /> including but not limited to, abandoned lines, or permanent fill <br /> tube extensions must be capped or modified in any way, or if any <br /> buried manhole or any other vapor trap must be vented, such action <br /> shall be the sole responsibility of the owner-Operator. It shall <br /> be the sole responsibility of the Owner-Operator to verify that <br /> the information as shown in paragraph two (2) is accurate and <br /> correct, and to advise the contractor if the existing ground water <br /> level is above the bottom of the storage tank. <br /> 8 . If the Owner-Operator does not, for any reason, have the <br /> tank (s) ready for testing upon the arrival of Contractor' s testing <br /> crew, Owner-Operator shall pay Contractor for any waiting time, <br /> &/or lost time at the rate of $42 .50 per manhour. If a not tight <br /> system condition is determined and the Owner-Operator desires to <br /> have Contractor further investigate the source (s) &/or effect <br /> repair(s) ; Contractor shall conduct such extra work at the rate of <br /> $42 .50 per manhour plus the cost of repair materials as needed. <br /> Retests are not included in this agreement. <br /> CONTRACTOR OWNER-OPERATOR <br /> Integrity Tank Testing Services, Panella Trucking, Inc. <br /> a Business Trust <br /> 166 Frank West Circle P. 0.
