A monitoring system certification, leak detector testing, and spill container testing were performed on 10/21/2016. A test report has not been submitted to the EHD or the California Environmental Reporting System (CERS). A copy of the test report must be submitted within 30 days of the test. Immediately provide this report to the EHD. This is a Class II violation. 121 CCR 2712(f) Failed to submit a written response within 30 days of receiving an inspection report. An in office inspection report was issued on 3/11/17 identifying information to be submitted to bring this site into compliance. This information was required to be submitted by 4/10/17, a partial return to compliance was received on 3/20/2017. However, a valid BOE was not submitted at that time. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. 204 CCR 2712(i) Current monitoring plan approved by the EHD not found on site. An approved copy of the monitoring plan were not available for inspection. A copy of these plans shall be accessible on site at all times. Immediately locate and retain a copy on site. This was corrected on site. This is a Class II violation. 209 CCR 2715(c) Designated operator did not inspect all required items and/or the inspection reports not completed. The designated operator failed to check and note the correct test dates for the Secondary Containment Testing on the October 2016 to October 2017 designated operator monthly inspection reports. The Designated Operator noted the last Secondary Containment Testing was done on 10/26/2017, but EHD received notification for testing date on 10/27/2016. During the monthly inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and document the dates they were done. Ensure that designated operators performing monthly inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class II. 315 HSC 25291(e) Water in secondary containment not removed, analyzed, and properly disposed of (pre-Jul 2003). Liquid was observed in the diesel sump. If water could enter into the secondary containment by precipitation or infiltration, it must be removed and disposed of properly. Immediately remove this liquid, make a hazardous waste determination per Title 22 hazardous waste regulations, and manage it accordingly. Ensure that the diesel sump is maintained free of liquid.
