Charter Way, Stockton <br />Program: UST <br />SUMMARY OF VIOLATIONS <br />CLASS I, CLASS 11, or MINOR -Notice to Comply) <br />ROUTINE ANNUAL INSPECTION AND MONITORING SYSTEM CERTIFICATION <br />Violations: (17, 21, 23d) <br />17. The 91 line leak detector failed to detect a leak when tested. All line leak detectors shall be capable <br />of detecting a 3 -gallon per hour leak at 10 psi. Immediately have a properly licensed, trained, and <br />certified contractor repair or replace the failed leak detector (LG 113-x listed, if applicable) and obtain a <br />permit within one business day from the EHD. If the failed leak detector can't be replaced immediately, <br />there is a possibility that the 91 UST system may be red tagged to prevent fuel inputs. <br />21. Liquid was observed in the UDC 3/4 and 7/8 sumps. If water could enter into the secondary <br />containment by precipitation or infiltration, it must be removed and disposed of properly. Immediately <br />remove this liquid, make a hazardous waste determination per Title 22 hazardous waste regulations, <br />and manage it accordingly. Ensure that the UDCs are maintained free of liquid. <br />23d. The designated operator employee training for Jassy Singh was not performed. Mr. Singh was the <br />only employee on site at the time of inspection. The designated operator shall train facility employees <br />for which he or she is responsible in the proper operation and maintenance of the UST system once <br />every 12 months. The training shall include, but is not limited to: <br />1. Operation of the UST system in a manner consistent with the facility's best management practices <br />2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan <br />3. Employee's role with regard to spills and overfills as specified in the facility's response plan <br />4. Name of the contact person(s) for emergencies and monitoring equipment alarms <br />At least one of the facility employees present during operating hours shall have current training. Ensure <br />that employees have been trained by the designated operator, maintain the list on site, and submit a <br />copy of the training records to the EHD by July 6, 2011. <br />REPEAT VIOLATION <br />Complete and submit a copy of the Return to Compliance Certification to the EHD by July 6, 2011 along <br />with a statement documenting the corrective actions that have been or will be taken for each violation <br />and any supporting paperwork. <br />Note: The financial responsibility documentation for 2011 was submitted at the time of inspection, <br />however, it was taken back by the owner for corrections and will be resubmitted when complete. <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122). <br />THIS FACILITYA SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />Re y: <br />Title: <br />EHD 23-024@j/0811 0/10 CONTINUATION FORM <br />
