(c) For purposes of compliance with chapter 18 of this division (commencing with <br />section 66268.1), or if the waste is not listed as a hazardous waste in article 4 <br />(commencing with section 66261.30), in article 4.1 (commencing with section <br />66261.50), or in Appendix X of chapter 11 of this division, the generator shall <br />determine whether the waste exhibits any of the characteristics set forth in article 3 <br />of chapter 11 of this division by either: <br />(1) testing the waste according to the methods set forth in article 3 (commencing <br />with section 66261.20) of chapter 11 of this division, or according to an <br />equivalent method approved by the Department under section 66260.21; or <br />(2) applying knowledge of the hazard characteristic of the waste in light of the <br />materials or the processes used. <br />(d) If the waste is determined to be hazardous, the generator shall refer to chapters 14, <br />15, 18, and 23 of this division for possible exclusions or restrictions pertaining to <br />management of the specific waste. <br />4 Industrial wastewater was discharged into the facility's septic system without <br />making a determination if the waste was hazardous prior to doing so. <br />Title 22, CCR 66262.34(f) Failed to completely label containers or tanks of <br />hazardous waste. Generators who accumulate hazardous waste on site without a <br />permit or grant of interim status shall comply with the following requirements: <br />(1) the date upon which each period of accumulation begins shall be clearly marked and <br />visible for inspection on each container and portable tank; <br />(2) the date the applicable accumulation period specified in subsection (a) or (d) of this <br />section begins, for purposes of subsections (a) and (b) of this section, shall be <br />clearly marked and visible for inspection on each container and tank; and <br />(3) each container and tank used for onsite accumulation of hazardous waste shall be <br />labeled or marked clearly with the words, "Hazardous Waste." Additionally, all <br />containers and portable tanks shall be labeled with the following information: <br />(A) composition and physical state of the wastes; <br />(B) statement or statements which call attention to the particular hazardous <br />properties of the waste (e.g., flammable, reactive, etc.); <br />(C) name and address of the person producing the waste. <br />4 Six 55 -gallon containers of waste acids were found not labeled with the <br />physical state during the May 26, 2010, hazardous waste inspection. <br />4 One 55 -gallon container of waste lubricating oil was found not labeled with the <br />hazardous property and accumulation start date during the May 26, 2010, <br />hazardous waste inspection. <br />Title 22, CCR 66265.16 Personnel training records incomplete. <br />(a) (1) Facility personnel shall successfully complete a program of classroom instruction <br />or on-the-job training that teaches them to perform their duties in a way that <br />ensures the facility's compliance with the requirements of this chapter. The owner <br />or operator shall ensure that this program includes all the elements described in <br />the document required under subsection (d)(3) of this section. <br />(2) This program shall be directed by a person trained in hazardous waste <br />management procedures, and shall include instruction which teaches facility <br />personnel hazardous waste management procedures (including contingency plan <br />implementation) relevant to the positions in which they are employed. <br />(3) At a minimum, the training program shall be designed to ensure that facility <br />personnel are able to respond effectively to emergencies by familiarizing them <br />5 <br />
