Gleason <br /> Downey Brand Attorneys, LLP <br /> 555 Capitol Mail, 10"' Floor <br /> Sacramento, CA 95814 <br /> Re: HERITAGE SQUARE, 640 N SAN JOAQUIN ST, STOCKTON CA <br /> Dear Ms. Gleason: <br /> This letter is in response to your letter dated June 10, 2003, requesting that the San Joaquin <br /> County Environmental Health Department (EHD) confirm that your clients, David and Marianne <br /> Warwick, were directed to perform corrective action due an unauthorized release from an <br /> underground storage tank located at the above referenced address. <br /> The following is a chronological summary of EHD activities associated with this site: <br /> • On January 31, 2002, a permit application to drill geotechnical borings to determine <br /> structural soil properties was submitted to the EHD. Destruction of the boreholes was <br /> witnessed by EHD staff on February 6, 2002. <br /> • On May 22, 2002, EHD staff received a call from Condor Earth Technologies (CET) <br /> stating that a supply and a return line traced to an underground storage tank (UST) had <br /> been discovered while trying to repair a broken water line. They requested that EHD <br /> staff respond to witness collection of samples from under the UST system lines so that <br /> the water line could be repaired and water supply restored to two occupied buildings at <br /> the site. The EHD staff agreed to observe the sampling with the understanding that an <br /> UST system (tank and piping) removal plan be submitted the following day. <br /> • Collection of samples from under the exposed piping was witnessed on May 22"d. On <br /> May 23d, EHD staff witnessed collection of soil samples from an angle boring placed <br /> under the UST located along the east foundation of the Women's Center property. The <br /> location of a second tank was suspected but had not been confirmed at that time. The <br /> presence of an abandoned water well was documented by EHD staff. <br /> • On May 281h, an application for a permit to remove the previously unidentified UST, <br /> located north of the Heritage Square building was submitted by CET. On page 4, Item 5, <br /> of that submittal, the applicant noted "During the removal of the pipes, small amounts of <br /> bunker oil leaked from the break points." <br />
