1 including but not limited to diesel and/or gasoline failed to establish and implement a business plan <br /> 2 for emergency response to a release or threatened release of a hazardous material for 717 W. 8th St., <br /> 3 Stockton, California; <br /> 4 b. Violating Health and Safety Code section 25504(b), failing to have a business <br /> 5 plan which includes emergency response plans and procedures in the event of a reportable release or <br /> 6 threatened release of a hazardous material, including but not limited to the following: <br /> 7 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 8 Services and to the appropriate local emergency rescue personnel; <br /> 9 2. Procedures for the mitigation of a release or threatened release to <br /> 10 minimize any potential harm or damage to persons, property, or the environment; <br /> 11 3. Evacuation plans and procedures, including immediate notice, for the <br /> 12 business site; <br /> 13 c. Violating Health and Safety Code section 25504(c), failing to train all new <br /> 14 employees and annual training, including refresher courses, for all employees in safety procedures <br /> 15 in the event of a release or threatened release of a hazardous material,including,but not limited to, <br /> 16 familiarity with the plans and procedures specified in Health and Safety Code section 25504(b); <br /> 17 d. Violating Health and Safety Code section 25505, failing to submit a business <br /> 18 plan for emergency response to a release or threatened release of hazardous material for the year <br /> 19 2007 for 717 W. 8th St., Stockton, California to the San Joaquin County Office of Emergency <br /> 20 Services. Further, it is alleged that said violation was knowingly committed after reasonable notice; <br /> 21 e. Violating Health and Safety Code section 25505(e)(2), failing to annually submit <br /> 22 a form,provided by the San Joaquin County Office of Emergency Services,that certifies that the <br /> 23 handler has included, and maintains as current, in the business plan, all other information required <br /> 24 by Health and Safety section 25504; <br /> 25 6. Defendant, in the course of Defendant's GASOLINE STATION activities, are pursuant <br /> 26 to Business and Professions Code section 17204 hereby are permanently enjoined from: <br /> 27 a. Violating Health and Safety Code, section 25507(a), failing to timely report a <br /> 28 release or threatened release of a hazardous material, including but not limited to petroleum; <br /> -3— <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
