Accumulating universal waste for longer than one (1) year from the date the <br />universal waste is generated, or received from another handler, in violation of California Code of <br />Regulations, title 22 section 66273.15(a); <br />i. Failing to demonstrate the length of time that the universal waste has been <br />accumulated from the date it becomes a waste or is received, in violation of California Code of <br />Regulations, title 22 section 66273.15(c). <br />4. Defendant, in the course of Defendant's GASOLINE STATION activities, are pursuant to <br />Health and Safety Code, section 25280 et seq., are hereby permanently enjoined from: <br />a. Failing to maintain evidence of financial responsibility, in violation of Health and <br />Safety Code section 25292.2(a); <br />b. Failing to implement a monitoring program approved by the local agency and <br />specified in the underground storage tank operating permit, in violation of California Code of <br />Regulations, title 23 section 2632(b); <br />c. Failing to comply with underground storage tank repair and upgrade requirements, <br />in violation of California Code of Regulations, title 23 section 2661. <br />5. Defendant, in the course of Defendant's GASOLINE STATION activities, are pursuant to <br />California Business and Professions Code, section 17204 hereby permanently enjoined from: <br />a. Violating Health and Safety Code section 25100 et seq., as described in paragraph 3 <br />3i above; <br />b. Violating Health and Safety Code section 25280 et seq., as described in paragraph 4 <br />- 4c above. <br />6. Defendant shall pay to Plaintiff the sum of FOURTEEN THOUSAND DOLLARS <br />($14,000.00), as and for civil penalties, pursuant to Health and Safety Code §25299. Said payment <br />shall be made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH <br />DEPARTMENT - ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be <br />delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, <br />at the time of signing. <br />PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
