The following is an itemized list of hazardous waste violations that have not been addressed <br /> for Quick Stop Mart as of June 10, 2015. <br /> Open violations from April 07, 2014 inspection <br /> Violation #122 -Failed to keep signed copy of manifests from the designated facility for 3 years <br /> Violation #705 - Failed to send copy of generator manifest to DTSC with an indication that copy of <br /> manifest signed by destination facility was not received after 60 days <br /> Manifest number 007271639JJK(7/26/11)was not found on site. Hazardous waste generators shall retain copies <br /> of all manifests for three years or until a copy signed off by the destination facility is received. The signed off copy <br /> shall be retained and made readily available for review for three years. If the generator did not receive a copy of <br /> the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste <br /> was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall <br /> submit a legible copy of the missing manifest, with some indication that the generator has not received <br /> confirmation of delivery. This information shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifest or prepare and submit the required information to DTSC. <br /> Submit to the EHD a copy of the signed off copy of the manifests or a copy of the information submitted to DTSC. <br /> REPEAT VIOLATION <br /> Violation #135 - Failed to submit a written response within 30 days of receiving an inspection report <br /> The complete Return to Compliance paperwork for the April 1, 2013 and the December 16, 2011 inspections was <br /> not submitted. A deficiency letter for the 2013 inspection was issued November 26, 2013. A deficiency letter for <br /> the 2011 inspection was issued July 23, 2012. The operator of the site or facility which receives an inspection <br /> report shall submit a written response to the department or the local officer or agency within 60 days of receipt of <br /> the inspection report, or with a shorter time as the department or local agency requires. This response shall <br /> include a statement documenting the corrective actions that have been or will be taken by the operator. <br /> Immediately submit all necessary follow up paperwork for the 2013 and 2011 hazardous waste generator <br /> inspections to the EHD. REPEAT VIOLATION <br /> Violation#407 -An empty HW or Haz Mat container(larger than 5 gallons)was not marked with the date it <br /> was emptied and/or not managed within one year of being emptied <br /> A 55 gallon blue steel drum and a 55 gallon black steel drum which previously held "oily water"were observed in <br /> the hazardous waste storage area without labeling. Both of these drums were observed on site on April 1, 2013 <br /> containing liquids. A disposal record dated May 31, 2013 indicates that"oily water" was pumped from both <br /> drums. Containers larger than five gallons that previously held a hazardous material shall be marked as empty <br /> with the date they were emptied and managed within one year of being emptied. Immediately mark and manage <br /> all empty containers per this section. <br /> Violation #703 - Failed to comply with Code of Federal Regulations 262.34(d), (e) & (f) <br /> CFR 262.34(d)(5)(i) No emergency coordinator <br /> CFR 262.34(d)(5)(ii) No modified contingency plan <br /> CFR 262.34(d)(5)(iii) Failed to train all employees on waste handling and emergency procedures <br /> CFR 262.34(d)(5)(iv) Failed to respond to a fire, spill or other release <br /> The emergency coordinator information is outdated. The only emergency coordinator listed is Sukhwinder Singh. <br /> According to Mr. Umer Hayat, the employee on site, Mr. Singh is not currently available and the emergency <br /> coordinator for the site is Mr. Billa Dhillon. There must be at least one emergency coordinator on site or on call to <br /> coordinate emergency response measures, and the following information must be posted by a phone: the name <br /> and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if <br /> present, fire alarm; and the phone number of the fire department, unless the facility has a direct alarm. <br /> Immediately update the emergency coordinator information and post the required information by a phone. Submit <br /> proof of correction to the EHD by May 7, 2014. REPEAT VIOLATION <br /> Page 3 of 5 <br />
