January 10, 2008
To: Kasey Foley
From: Muniappa Naidu
Re: Disabling mechanical overfill at Loves Country Store, 1553 Colony Drive, Ripon.
I was at the above site to witness a drop tube replacement on December 7, 2008 at 10:00
am. I met with Larry Williams of Alpha Petroleum Service, Inc. I asked him if he had a
tank chart and he said no. That started a big effort to find a tank chart by the manager
and crew of Loves Country Store. The truck driver that drops fuel for this facility was
also helping. The tank chart could not be located thus it was decided that the drop tube
replacement would be performed another day.
During the conversation the truck driver, who is an employee of Loves county store,
asked us what we were doing. I informed him that the service technician was replacing
the drop tube. The technician informed me that the mechanical flapper was set at
approximately 85% and they need it at 95%. The truck driver mentioned that he uses the
tank stick when filling the underground storage tanks. I told him that he should not do
that. He said everybody does. I said everybody doesn't do that and if he was using a
stick to override the mechanical overfill, he should immediately stop. He said he lied
than left.
I reminded the service technician that he would be my witness for this incident if it went
any further. The tech nodded and asked "why would he say something like that?"
I left the facility at 11:30 am
