CALIFORNIA GAS STATION, LLC, ET AL 39 -2011 -00263259 -CU -BC -STK ATTACHMENT (Number) : 4(h) (This Attachment may be used with any Judicial Council form.) Plaintiff sold a gas station to Defendant. Plaintiff also subleased another gas station to Defendant. After Defendant defaulted under the purchase agreement and sublease, Plaintiff filed two actions. The first action was for unlawful detainer. That action resulted in judgment in favor of Plaintiff, and Defendant's appeal has been dismissed. Plaintiff has recovered possession of the property. Plaintiff filed this action to judicially forclose on a deed of trust and recover damages against guarantors of the purchase agreement. After the action was filed, Plaintiff elected to conduct a trustee's sale under the deed of trust. The Trustee's sale occurred in August 2012. Plaintiff purchased the property at the sale. The parties have been in settlement discussions for the past several months. It is hoped a global settlement of the claims can be reached in this matter.
