MC -025 <br />SHORT TITLE: CASE NUMBER: <br />- VAN DE PUL v. CALIFORNIA GAS STATION, LLC, ET AL 39 -2011 -00263259 -CU -BC -STK <br />ATTACHMENT (Number) : 4(h) <br />(This Attachment may be used with any Judicial Council form.) <br />Plaintiff sold a gas station to Defendant. Plaintiff also subleased another gas station to Defendant. After Defendant <br />defaulted under the purchase agreement and sublease, Plaintiff filed two actions. The first action was for unlawful <br />detainer. That action resulted in judgment in favor of Plaintiff, and Defendant's appeal has been dismissed. Plaintiff has <br />recovered possession of the property. <br />Plaintiff filed this action to judicially forclose on a deed of trust and recover damages against guarantors of the purchase <br />agreement. After the action was filed, Plaintiff elected to conduct a trustee's sale under the deed of trust. The Trustee's <br />sale occurred in August 2012. Plaintiff purchased the property at the sale. <br />The parties have been in settlement discussions for the past several months.
