In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> 1)The 87-octane line leak detector failed to detect a leak when tested on 6-8-2016. All line leak detectors shall be <br /> capable of detecting a 3-gallon per hour leak at 10 psi. EHD required you to immediately have a properly licensed, <br /> trained,and certified contractor repair or replace the failed leak detector(LG 113-x listed,if applicable)and obtain a <br /> permit within one business day from the EHD. To date no permit for its repair has been received. <br /> 2)One of the turbine relays was replaced on 2-12-15 and a permit was not obtained from the EHD (per the Donlee <br /> Pump Company(Donlee Pump) work order,no indication as to which product relay was-replaced was provided on <br /> that work order).This is a historical violation,first noted on the 6-11-2015 Environmental Health Department(EHD) <br /> inspection report.A return to compliance certification dated 11-17-2015,indicated that this facility is working with <br /> Donlee Pump to resolve the issue,however,to date no permit application for the above work has been received by <br /> EHD. <br /> 3)Other un-permitted repairs took place at this site, including but not limited to: L8 sensor in the 87-octane annular <br /> appears to have been replaced according to the maintenance record dated 6-29-2015, L10 annular sensor was <br /> replaced per the 12-19-2015 Donlee Pump maintenance record,87-octane line leak detector failed and was replaced <br /> per the 01-04-2016 Donlee Pump maintenance record. <br /> FAILURE TO IMMEDIATELY C)MPLY WITH THIS NOTICE MAY RESULT IN ADDITIONAL VIOLATIONS <br /> Inspected By: Print Name: Elena Manzo <br /> ignat oegistered Environmental Health Specialist <br /> Received By: Date: CJI —o� <br /> Signa�u a of Owner/Operator <br /> REV 04/19/12 NOTICE OF SIGNIFICANT VIOLATION <br />
