(RETREADER): <br /> This letter is to notify your company of errors and/or omissions on Comprehensive Trip Log(CTL)forms <br /> submitted by your business. On August 13, 2012,the Department of Resources Recycling and Recovery <br /> (CalRecycle)mailed out a warning notification about waste tire haulers using"incorrect"or"closed out" <br /> Tire Program Identification(TPID)Numbers. Attached,please find recent examples of CTL forms <br /> containing TPID numbers that are no longer valid.As the hauler, it is your responsibility to ensure that all <br /> CTL forms are accurate and complete. Failure to provide correct information on these forms is considered <br /> falsification of a manifest document pursuant to Public Resources Code(PRC) § 42962, and can be <br /> punishable up to$25,000 per violation per day. Furthermore,failure to provide complete information on <br /> these forms will be considered a violation of Title 14,California Code of Regulations(CCR) §18459. Listed <br /> below are the applicable PRC and CCR sections. <br /> PRC §42962. <br /> (a)Any person who does any of the following shall be liable for a civil penalty not to exceed <br /> twenty-five thousand dollars($25,000)for each violation of a separate provision or for continuing <br /> violations for each day that violation continues: <br /> (2)Knowingly, or with reckless disregard,makes any false statement or representation in <br /> any application,manifest,record,report,permit,or other document filed, maintained, or <br /> used for purposes of compliance with this chapter. <br /> CCR§ 18459.Waste Tire Manifest System Requirements. <br /> (b)The Manifest Form shall be completed and signed under penalty of perjury by the appropriate <br /> representative, and accompany each shipment of used or waste tires from the point of origin to the <br /> facility. <br /> Please be aware that CalRecycle staff or its representatives will continue to audit your CTL records to <br /> determine compliance. Further,CalRecycle staff or its representatives may conduct a routine inspection at <br /> your facility as a follow-up to this notification.
