Any person who generates a waste shall determine if the waste is a hazardous waste. <br />Metal particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a <br />hazardous waste. Immediately disposal of all solid hazardous wastes as non-RCRA oily solids, make a hazardous <br />waste determination for the grinding, sanding, and bead blast wastes, and manage them according the Title 22 <br />hazardous waste regulations. Submit a statement and supporting documentation explaining how these wastes will <br />be managed. <br />This is a Class 11 violation. <br />106 <br />CCR 66265.51 Failed to prepare and implement a contingency plan. <br />Facility failed to prepare a contingency plan. The owner or operator shall prepare a contingency plan designed to <br />minimize hazards to human health or the environment from fires, explosions, or any unplanned release of <br />hazardous waste to air, soil, or surface water and immediately implement that plan whenever there is a fire, <br />explosion, or release of hazardous waste which could threaten human health or the environment. The contingency <br />plan must include: <br />1. Description of actions facility personnel will take in response to fires, explosions, or any sudden or <br />non -sudden release of hazardous waste to air, soil or surface water at the facility; <br />2. Description Of arrangements made with local police departments, fire departments, hospitals, contractors and <br />State and local emergency response teams to coordinate emergency services; <br />3. List of names, addresses, and phone numbers (office/home/cell) of all persons qualified to act as emergency <br />coordinator. Where more than one person is listed, one shall be named as the primary emergency coordinator and <br />all others in order in which they will assume responsibilities; <br />4. List all emergency equipment, which includes location, physical description, and brief outline of its capabilities; <br />5. Evacuation routes for facility personnel where there is a possibility of evacuation; <br />6. Current telephone number for State Office of Emergency Services. <br />If the facility has a Spill Prevention, Control and Countermeasures plan, or some other emergency or contingency <br />plan, the owner or operator need only amend that plan to incorporate hazardous waste management provisions that <br />are sufficient to comply with the requirements of this chapter.
