Aerosol cans are used in the business. According to Joseph Smith, if the propellent runs out before the can is drained, the nozzel is removed and the can is placed into a drum. The drum is then taken out as universal waste with Ramos Oil. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately make a hazardous waste determination for the aerosol waste, and manage it according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a repeat violation, Class Il. 601 CCR 66262.34(a) Stored hazardous waste on site longer than 90 days without a permit or authorization. One white 5 gallon plastic bucket containing metal shavings was observed with no accumulation start date. According to the manager, Joseph Smith, the waste was over 90 days old. Facilities who generate more than 1000 kg of hazardous waste per month may store waste on site up to 90 days. Since it cannot be determined how long the hazardous waste has been on site, immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest. Submit a copy of the manifest to the EHD within 30 days. This is a Class II violation.
