5.7 Services related to litigation support or testimony in connection with or arising out of <br /> the work performed by Contractor hereunder is not within the Scope of Services <br /> covered by this Agreement unless specifically indicated as an add-on service. In the <br /> event such services are required and are not indicated as an add-on service, Customer <br /> agrees to pay Contractor in accordance with the Rates for any litigation support or <br /> testimony provided by Contractor in connection with, or arising out of,the work <br /> performed by Contractor hereunder. <br /> ARTICLE 6. Changes in Work <br /> 6.1 In the event that changed or unforeseen circumstances at the work site necessitate <br /> changes in the work, Customer agrees to pay Contractor at the Rates, or for such costs <br /> incurred which are not delineated in the Rates, for any costs incurred or delays which <br /> may occur during Contractor's response to any emergency condition which threatens <br /> safety of persons or property during the performance of the Services. <br /> 6.2 If any change occurs during the term of this Agreement with respect to any laws, rules, <br /> regulations or ordinances which affect the rights or obligations of Customer or <br /> Contractor under this Agreement, or the applicability of any taxes or fees, or the cost of <br /> handling waste materials, Customer and Contractor shall negotiate in good faith to bring <br /> this Agreement into conformance with such change or changes. In the event that such <br /> agreement cannot be reached, Customer or Contractor shall have the right to terminate <br /> this Agreement immediately upon written notice to the other party. <br /> ARTICLE 7. Insurance <br /> 7.1 Contractor shall keep in effect during the term of this Agreement the following <br /> insurance coverages: <br /> COVERAGE LIMITS <br /> a. Worker's Compensation Statutory <br /> b. Employer's Liability $2,000,000 <br /> $2 million per occurrence <br /> c. General Commercial Liability $4 million aggregate <br /> d. Automobile $5 million combined single limit <br /> $10 million each Claim <br /> e. Contractors Pollution Liability $10 million all Claims <br /> 7.2 Contractor shall provide Customer with a certificate of insurance upon written request. <br /> ARTICLE S. Indemnification <br /> 8.1 Contractor shall indemnify, defend and hold harmless Customer, its parent and <br /> affiliated companies and their respective directors, officers, employees and agents from <br /> and against any and all costs, liabilities, claims, demands and causes of action <br /> Page 4 of 7 <br /> OGC/Rev 06/2014 <br />
