In this way, Tuff Boy could stage, in bulk manner, (1) a reasonable quantity of <br /> mixed good useable "maintenance ready used tires", (2) defective tires awaiting manufacture's <br /> adjustment, (3) retreadable casings and (4) waste tires destined for disposal. <br /> In addition, Tuff Boy was informed that they would be allowed to store an unregulated amount of <br /> new tires or new retreaded tires to be offered for sale or consumption. <br /> Furthermore, Tuff Boy was informed that they would be allowed to store an unregulated amount <br /> of"maintenance ready used tires" provided that the tires are barrel stacked, racked, or row <br /> stacked in accordance with SJCEHD guidelines. <br /> With that in mind, Tuff Boy has a few questions needed to clarify whether or not, the proposed <br /> additional re-designation, to that of a tire dealer classification, grill ultimately allow Tuff Boy to <br /> conduct regular California vehicle safety inspections, while operating in full compliance with <br /> SJCEHD guidelines, without creating a costly and unfair burden to the Tuff Boy operation, <br /> Questions are: <br /> 1. If Tuff Boy chooses to add a tire dealership category to its present business operation, <br /> would the Tuff Boy operations need to undergo any modifications to our facility to <br /> become compliant with SJCEHD? <br /> 2. As a tire dealer, is it accurate to expect that Tuff Boy will be allowed to loose bulk stack <br /> "waste" tires in any manner up to a total amount of 1,500 tires at the Tuff Soy facility? <br /> 3_ As a tire dealer, is it accurate to expect that Tuff Boy will be allowed to store an unlimited <br /> quantity of "maintenance ready used tires", provided those tires are barrel stacked or <br /> row*stacked in a manner that allows for inspection from,a minimum of one side? (see <br /> drawings 1 and 2 attached). <br /> 4. Asa tire dealer, is it accurate to expect that Tuff Boy will be allowed to store an unlimited <br /> quantity of new tires with no limitation on storage requirements? <br /> 5. As a tire dealer, is it accurate to expect that Tuff Boy will be allowed to store an amount <br /> to be determined quantity of retreadable casings, provided those tires are barrel stacked <br /> or row stacked in a manner that allows for inspection from a minimum of one side? (see <br /> drawings 1 and 2 attached). <br /> 6. As a tire dealer, is it accurate to expect that Tuff Boy will be allowed to store an unlimited <br /> quantity of new retreaded tires with no limitation on storage requirements? <br /> 7. As a tire dealer, is it accurate to expect that Tuff Boy will'be allowed to bulk store new <br /> tires into an enclosed portable over-the-road-highway van trailer to reduce the chance of <br /> theft or vandalism? <br /> 8. As a tire dealer, will SJCEHD allow"maintenance ready used tires" to be rowstacked <br /> into a portable over-the-road-highway van trailer as detailed on drawing #2 attached to <br /> reduce the chance of theft or vandalism? <br /> 9. Since Tuff Boy does not expect to ever have over 250 true "waste" tires staged for <br /> disposal on site at any one time, is there any other business designation that might more <br /> appropriately fit Tuff Boy's business operation rather than the "tire dealer category" <br /> proposed by SHCEHD? <br /> 10. Will a change in how SJCEHD views Tuff Boy's business type, resulting from an <br /> additional categorical change as a tire dealer, create a situation that might cause <br /> additional use permit requirements or any other additional permit requirements to be <br /> mandated to Tuff Boy? <br /> Also, at the July 15, 2010 meeting, Tuff Boy voiced concerns on the difficulty they were <br /> experiencing when filling out and recording over the road"waste tire hauling manifests". <br /> Keeping that thought, your assistance in answering a few more questions would be appreciated. <br /> 2 <br />
