Yosemite Ave. <br /> Lathrop, CA 95330 <br /> Dear Mr. Perkins, <br /> This letter is in response to the questions you submitted to the Environmental Health Department(EHD) <br /> on August 11,2010. All responses are based on waste tire laws found in Title 14 of the California Code <br /> of Regulations (T14CCR) and the Public Resources Code (PRC). Responses are also based on Tuff Boy <br /> being classified as a tire dealer. You can find the CCR on the Department of Resources Recycling and <br /> Recovery(CalRecycle) website(www.calrecycle.ca.gov/). You can also find the PRC at <br /> www.le ink fo.ca.gov/calaw.html. Each numbered response corresponds to the numbered question you <br /> submitted. <br /> 1. If Tuff Boy changes their category to a tire dealer, no physical modifications to the facility would <br /> be required by the EHD. Tuff Boy would be allowed up to 1,500 waste tires on-site. <br /> 2. Tuff Boy would be allowed to store up to 1,500 waste tires in any manner that Tuff Boy sees fit. <br /> However, if the number of stored waste tires exceeds 500,the storage of the waste tires outdoors <br /> must be in compliance with the requirements under Title 14 Section 17354. <br /> 3. Tuff Boy would be allowed to store an unlimited quantity of"maintenance ready used tires" so <br /> long as (1)the tires are stored in a rack or stack not more than two rows wide, but not in a pile, <br /> and is stored in accordance with local fire and vector control requirements and with state <br /> minimum standards (T14CCR Section 17353 and 17354) and(2) stored in a manner to allow the <br /> inspection of each individual tire. These requirements are under PRC Section 42806.5. <br /> 4. Tuff Boy would be allowed to store an unlimited quantity of new tires with no limitation on <br /> storage requirements. <br /> 5. Retreadable casings are considered waste tires and will be counted as part of the 1,500 waste tire <br /> limit regardless of the method of storage. <br />
