a. SJCEHD indicated that none of the current interactions with Tuff Boy are subject to
any charges.
25. Tuff Boy question submitted to SJCEHD on August 11, 2010.
Is it unreasonable for Tuff Boy to expect that SJCEHD will allow a reasonable amount of
time to achieve meaningful compliance while both parties work through the issues
brought forth in this letter?
SJCEHD response to Tuff Boy on August 19, 2010.
The EHD has a commitment to work with all of the regulated facilities in San Joaquin
County. If there are issues that require additional time for resolution then additional time
will be provided. That is not to say that compliance deadlines can be put off
indefinitely. The immediacy of the issue depends on the risk the issue poses to the
public health and the environment and to a lesser extent the compliance history of the
operator. The EHD looks forward to working with Tuff Boy Trailer Sales Inc. to resolve
this issue.
Additional comments/questions by Tuff Boy submitted to SJCEHD on
October 01, 2010
a. None
Further comments based on discussion held on October 19, 2010.
a. SJCEHD and Tuff Boy had no further discussion.
Following the October 19, 2010 meeting, Tuff Boy would like to thank SJCEHD for their
assistance in supplying the information necessary to gain a better understanding of what steps
Tuff Boy must take to meet the goals and needs of the SJCEHD waste tire handling program.
In closing, Tuff Boy has done it's very best to capture the letter and spirit of the discussions with
the expectation of utilizing this letter in modifying its business operations in a sustainable and
ongoing manner. Tuff Boy intends to rely on the accuracy and completeness of this letter in
conducting its business. If there are any misunderstandings, I would very much appreciate that
such matter be brought to my attention in the immediate future. If on the other hand, you agree
that this letter does set forth the nature of the discussions, I would likewise appreciate a short
memo reflecting that SJCEHD affirms Tuff Boy's understanding.
Y rs truly
Br' e erkins
BP:yw
attach.
cc: Michael Babitzke, Esq.
12
