In the <br /> past, Caltrans maintenance stations and fueling facilities had hundreds of operating USTs. <br /> Caltrans has removed USTs and closed the majority of their sites. During removal of the <br /> operating USTs, soil and/or groundwater contamination was detected at many of the sites. In <br /> response to the contamination, Regional Water Quality Control Boards (Regional Water Boards) <br /> and Local Agencies have required various levels of site assessment, monitoring and/or <br /> remediation. Currently, Caltrans has approximately 60 cleanup sites. <br /> Typically, Regional Water Boards have issued orders to Caltrans pursuant to Water Code <br /> sections 13267 or 13304 to address the contamination, while Local Agencies have issued <br /> cleanup directives pursuant to Health and Safety Code section 25296.10. According to many of <br /> the Regional Boards and Local Agencies, Caltrans has written letters and verbally expressed <br /> that it is not possible to conduct the required site assessments, monitoring, or remediation due <br /> to lack of funding from their headquarters. The failure to respond to the agencies' directives to <br /> conduct remediation or monitoring is a violation of the Water Code and UST laws and <br /> regulations. In addition, the suspension of remediation and/or monitoring threatens to impact <br /> water quality and the environment. <br /> Several Regional Water Boards and Local Agencies have requested assistance from the UST <br /> Enforcement Unit in obtaining compliance at Caltrans sites. The number of sites and counties <br /> potentially involved may be an indicator of widespread problems that could be pursued as a <br /> statewide case.
