RESOLUTION NO. 2009-310 <br /> RESOLUTION AUTHORIZING EXECUTION OF PERMIT <br /> DOCUMENTS FOR 2-GATE PROJECT DEVELOPMENTAND <br /> AUTHORIZING ACTIONS RELATED THERETO <br /> WHEREAS, the Board of Directors of the San Luis & Delta-Mendota Water <br /> Authority (the "Water Authority" and the "Board," respectively) has agreed through <br /> that certain Cooperation Agreement for 2-Gate .Project Development ("Cooperation <br /> Agreement") to work with other water agencies interested in projects to improve <br /> habitat conditions for sensitive species in the Sacramento-San Joaquin Rivers Delta <br /> ("Delta"), in order to resolve conditions which lead to curtailments of water supplies <br /> made available through the Delta for contractors of the State Water Project ("SWP") <br /> and the Central Valley Project ("CVP"). <br /> WHEREAS, under the Cooperation Agreement, the Water Authority is <br /> responsible to coordinate with and assist the United States Bureau of Reclamation in <br /> obtaining all permits for the 2-gates proposal, as a result of which, the Water <br /> Authority will apply in its own name for permits for the benefit of the Cooperating <br /> Parties required for access to private lands or for regulatory compliance for purposes <br /> of completing environmental analysis and obtaining geophysical information <br /> necessary for the development of the 2-gates proposal. <br /> WHEREAS, in order to proceed efficiently on the expedited schedule for the <br /> development of the 2-gates proposal, the Board wishes to consent to permit terms <br /> and conditions as may be negotiated by the Water Authority or required by <br /> permitting agencies and to authorize execution of permits and similar documents <br /> consistent with the sharing of responsibilities and liabilities provided for in the <br /> Cooperation Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: <br /> Section 1. The matters stated in the recitals above are true and correct, and <br /> the Board so finds, orders and determines. <br /> Section 2. The Board hereby authorizes the Executive Director or his <br /> designee to execute permits for access, permit letter agreements or permit terms, and <br /> such similar forms of documentation as may be required for the Water Authority <br /> from private parties and governmental agencies, such as the State Lands Commission, <br /> Department of Fish and Game, California Water Quality Control Board — Region S, <br /> 1 <br />
