Patricia Leary, Senior Water Resource Control Engineer and I reviewed the <br /> NPDES PERMIT APPLICATION (Application), received 24 March 2006 and submitted by <br /> Apex Envirotech, Inc. (APEX) on your behalf. In addition to my comments, please review the <br /> enclosed Memorandum (Memo) for comments to the Application from Patricia Leary. <br /> The Application proposes the extraction of petroleum hydrocarbon polluted groundwater from <br /> extraction wells located at New West Petroleum #1003 (Site) and treatment of that <br /> groundwater by a two-step process, a fluidized bioremediation bed reactor and granulated <br /> activated carbon canisters. The Application states the treated water will be discharged to the <br /> County Service Area (CSA) 31 storm sewer at the Site, which empties into a farm drainage <br /> ditch that leads to White Slough of the Sacramento-San Joaquin Delta, all of which are waters <br /> of the United States. <br /> The Application comments for the NPDES Permit are as follows: <br /> 1. The correct application forms were not used. The Application submitted by APEX is for <br /> General Order for Land Disposal of Groundwater and Surface Water from Cleanup of <br /> Petroleum Fuel Pollution, Order No. R5-2003-0044 (Discharge to Land), not General <br /> Order Discharge to Surface Waters of Groundwater from Cleanup of Petroleum Fuel <br /> Pollution, Order No. 5-00-119 (NPDES NO. CAG915001). The correct forms may be <br /> downloaded from our Internet web site at: <br /> http://www.waterboards.ca.gov/centralval ley/business_help/perm it3.htmi. <br /> Please submit the correct completed NPDES forms. <br /> 2. The correct filing fee of $5,688 was not included with the Application. Please submit <br /> the balance of the required filing fee. <br /> 3. The unconventional treatment process requires addition of nutrients which may cause <br /> impacts to water quality.
