You have indicated that <br /> New West Stations,Inc.is the UST Owner&Operator. However,on pages three and five of your <br /> claim application you indicate that New West Stations,Inc. is only the UST Operator. In addition, <br /> the current permit to operate is issued to New West Petroleum and the UST Upgrade Compliance <br /> Certification indicates the UST Owner and Operator is New West Petroleum. Please clarify and <br /> revise application appropriately to be consistent. Please clarify the affiliation between New West <br /> Stations,Inc. and New West Petroleum and appropriate eligible claimant name.' If New West <br /> Petroleum is a dba,provide documentation to show ownership. If there was a name change,provide <br /> documentation to show this. Is New West Stations,Inc.a parent company of New West Petroleum? <br /> If yes,provide documentation to show this. Also,provide a copy of Corporation's Secretary of State. <br /> • Claimant is required to provide documentation that all current and prior UST fees due on or after <br /> January 1, 1991 imposed by Section 25299.41 of the Health and Safety Code have been paid. If any <br /> of the USTs owned or operated had product placed in them on or after January 1, 1991, attach the <br /> most recent copy of the UST Fee Return Form filed with the State Board of Equalization(BOE)with <br /> proof of payment(copy of canceled check). <br /> • Page six(6)of your claim application was incomplete. Complete the Compliance Date under the <br /> Financial Responsibility section. Refer to the enclosed page eight(8) from the Financial <br /> Responsibility Guide to determine the appropriate date. <br /> • Provide a copy of the first permit to own/operate USTs from the local regulatory agency(Air <br /> Pollution permits are not acceptable). <br /> Claimant is advised that an eligible claimant must have either 1)owned or operated the subject leaking UST <br /> (permits are issued to New West Petroleum,not New West Stations,Inc.),2)is the responsible patty directed to <br /> undertake corrective action for the unauthorized release by the local regulator(The Leak Report and San Joaquin <br /> County's letter of 3/9/05 name New West Petroleum as named the responsible party,not New West Stations,Inc.), <br /> and 3)is the party paying for the costs of cleanup(you provided DE6s for New West Stations,Inc.). Note that <br /> claimant name and tax I.D.number must match and that claimant cannot be a dba.
