The Hoffman Brothers have previously requested that Chevron <br /> remove and over-excavate the soil in areas where it poses excess risks, at levels in excess of 105. <br /> However, Chevron has not responded. <br /> The Hoffman Brothers have been extremely patient in waiting for Chevron to meet its legal <br /> obligations as the responsible party for the petroleum contamination at the former Lyoth facility. <br /> The Hoffman Brothers have grown increasing frustrated by Chevron's inaction. However,unless <br /> affirmative action is taken in the near future,the Hoffman Brothers will be left with no recourse but <br /> to pursue legal action. <br /> We believe it is in Chevron's best financial interest to work with the Hoffman Brothers in a <br /> cooperative and cost effective manner that avoids the needless cost of litigation.
