No f=urther Action Required Determination -2 - 19 November 2009 <br /> Former Lyoth Loading Station & Lyoth Offsite <br /> residents and/or construction/trench workers. The consultant's findings supported by the <br /> California Office of Environmental Health Hazard Assessment (OEHHA) concluded that the <br /> residual crude oil remaining at both Sites does not pose a threat to human health for the <br /> construction/trench worker scenario. Additionally, the theoretical lifetime cancer risk <br /> calculated from the updated HRA is within an acceptable risk range for an assumed <br /> residential-setting scenario at the former loading station. Based on the characterization <br /> reports' findings combined with the risk assessments, the documentation provides the <br /> appropriate technical data and rationale to support a NFAR determination for both Sites. <br /> Central Valley Water Board staff received the Soil Management Plan (SMP) for both Sites <br /> dated 2 June 2009, that provides guidance for whoever may conduct future excavation and/or <br /> maintenance activities at both Sites. The SMPs, which designate Chevron as the responsible <br /> party for any issues that arise confirmed to be related to the crude oil leaks, was submitted to <br /> the owner of the former Lyoth Loading Station and the Lyoth Offsite properties determined to <br /> overlie affected soil and groundwater. Copies of the SMPs were provided to San Joaquin <br /> County Environmental Health Department staff. <br /> The owner of the Sites determined to overlie the affected area(s) and the owners of unaffected <br /> properties within a 500-foot radius of the approximate boundary of the affected soil and/or <br /> groundwater on both Sites, were notified by certified mail of the proposed closure and the <br /> opportunity to provide comments to Chevron's request for NFAR determination. No comments <br /> were received during the 30-day comment period. <br /> Provided the information submitted to this agency was accurate and representative, no further <br /> action is needed at the above-referenced Sites. If existing, additional, or previously <br /> unidentified chemical constituents confirmed to be associated with the former crude oil <br /> pipelines at the former Lyoth Loading Station and Lyoth Offsite project Sites cause or threaten <br /> to cause pollution or nuisance or are found to pose a threat to public health or water quality, <br /> then: 1) nothing in this determination is intended or shall be construed to limit or preclude the <br /> Central Valley Water Board or any other agency from taking enforcement action, and 2) this <br /> letter does not relieve Chevron of any responsibilities mandated under the California Health <br /> and Safety Code and the California Water Code. <br /> If you have any questions, please contact Dean Hubbard at (559) 445-5179. <br /> Pamela C.
