Hoffman <br /> 26577 South Banta Rd. <br /> Tracy, California 95304 <br /> Subject: Soil and Groundwater Management Plan <br /> Former Lyoth Loading Station <br /> 26501 South Banta Road <br /> Lyoth, San Joaquin County, California <br /> Dear Mr. Hoffman: <br /> As previously communicated to you,Chevron Environmental Management Company (CEMC) <br /> performed investigations related to former crude-oil pipeline operations at the former Lyoth Loading <br /> Station site(the Site). In April 2008,CEMC submitted a request for No Further Action status to the <br /> state regulatory agency—the Regional Water Quality Control Board (RWQCB)—with jurisdiction <br /> over the Site. In April 2009, the RWQCB requested the development of a soil and groundwater <br /> management plan for potentially affected soil and/or groundwater that may be encountered during <br /> future construction at the Site. <br /> Residual crude-oil constituents remain in the subsurface soil at the Site, and as they do not pose a <br /> threat to human health and the environment,the RWQCB has not required any further investigation <br /> or remediation of the Site by CEMC at this time. The enclosed soil and groundwater management <br /> plan (plan)provides information regarding actions that should be taken in the event that future <br /> incidental excavation or redevelopment activities take place at the Site that encounter crude-oil <br /> residuals. In such instance,CEMC will work with you or the current landowner to help mitigate the <br /> impacts of crude oil from pipeline operations to the extent practical. For your reference, the enclosed <br /> plan provides guidance on both your and CEMC's respective roles and responsibilities in the event <br /> crude-oil affected soil is encountered. As noted in the plan, should your plans for the Site include <br /> large-scale development,please notify CEMC well in advance in order that CEMC (in consultation <br /> with the RWQCB) can develop a project-specific plan. <br />
