No Further Action Required Determination - 2 - 6 January 2011 <br /> Banta Road-UPRR <br /> Tracy-Fresno Right-of-Way, Tracy <br /> On 16 November 2010, Central Valley Water Board staff submitted notification to owner(s) of <br /> properties determined to overlie the affected area(s) and/or owner(s) of properties within a <br /> 200-foot radius of the approximate boundary of the affected groundwater, by certified mail of <br /> Chevron's 9 March 2010 request for NFAR determination. No comments were received during <br /> the 30-day review period. <br /> Provided the information submitted to this agency was accurate and representative, no further <br /> action is needed at the above-referenced Site. If existing, additional, or previously unidentified <br /> chemical constituents confirmed to be associated with the former crude oil pipelines at the Site <br /> cause or threaten to cause pollution or nuisance or are found to pose a threat to public health <br /> or water quality, then: 1) nothing in this determination is intended or shall be construed to limit <br /> or preclude the Central Valley Water Board or any other agency from taking enforcement <br /> action, and 2) this letter does not relieve Chevron of any responsibilities mandated under the <br /> California Health and Safety Code or the California Water Code. <br /> If you have any questions, please contact Dean Hubbard at (559) 445-5179 or by email at <br /> dhubbard(a)waterboards.ca.gov. <br /> r <br /> Pamela C.
