9 0 <br /> _KEY INFORMATION REGARDING YOUR PHASE I ENVIRONMENTAL SITE ASSESSMENT <br /> The Applicability of Phase I Environmental Site Assessments is Limited <br /> Phase I Environmental Site Assessments are written to provide database search results, third <br /> Party information, observations, and professional opinions regarding a specific site for a specific <br /> Project. ESA reports do not eliminate all uncertainties about the site and are not exhaustive on <br /> record searches. The amount of research depends on the type of property, the expertise and <br /> risk tolerance of the client, and the information developed in the course of the inquiry. <br /> This Phase I ESA Report is viable for 180 days from the date the contract was signed. The <br /> Report is produced for the client and may not be used by a ifferent user without also satisfying <br /> the User's Responsibilities. <br /> User's Responsibilities <br /> Based on The ASTM Standard E1527-13 the user is requir, to perform the following tasks to <br /> meet the requirements to qualify for the innocent landowner defense within the scope of the <br /> Comprehensive Environmental Response, Compensation an Liability Act (CERCLA). <br /> • Review title and judicial records for environmental liens or activity and use <br /> limitations (AULs). <br /> • Communicate any specialized knowledge or experience to the environmental <br /> professional that is material to recognized environmental conditions in <br /> connection to the property. <br /> • Communicate any actual knowledge of environmental liens or AULs encumbering <br /> the property to the environmental professional. <br /> • The user shall consider the relationship of the purchase price of the property to <br /> the fair market value. if the amount is lower�� a written explanation of the lower <br /> value is required. <br /> • Any commonly known or reasonably ascertainable information about recognized <br /> environmental conditions in connection to th'e property must be communicated <br /> to the environmental professional. <br /> Contact Your Environmental Professional Wbe�by Doubt <br /> Time, money, and confusion can all be saved by simple explanations at critical moments. <br /> Please contact your environmental professional whenever there is any doubt regarding possible <br /> environmental conditions or their effect on part or all of any project. <br /> '.44 <br /> 2'2014 Nell O.Anderson 8 Associates, Inc <br /> A Terracon Company <br />
