The Regional Board's letter of 7 April states our concerns with the <br /> proposed project. If our information about the composition and reuse of the <br /> Renown material is incorrect, a request for an exemption from Subchapter 15 <br /> should clarify the matter. <br /> Before an exemption could be granted, the Regional Board needs the following <br /> information: <br /> 1 . A complete characterization of the material. Historical documentation and <br /> chemical analyses should be included. <br /> 2. A detailed plan for the reuse or disposal of the material. This should <br /> include on-going chemical analyses, construction plans, and a detailed <br /> description of the methods or conditions which will assure that this <br /> material will not adversely affect water quality once it is at its final <br /> destination. <br /> 3. A plan to monitor the effects of the disposal or reuse on ground water <br /> and/or surface water. <br /> In your letter, you state that the California Department of Transportation <br /> (Caltrans) will not accept the Renown material even if an exemption from <br /> Subchapter 15 is granted. Nevertheless, you request the Regional Board <br /> continue to process your request for an exemption in the hope that you will <br /> convince Caltrans to change its position. Our workload will not permit such an <br /> approach. If all proponents of the project wish to proceed with an exemption <br /> request, the information discussed in numbers 1 , 2 and 3 above must be provided. <br /> At that time, the Regional Board will proceed as expeditiously as possible. <br /> There appears to be two related, but separate issues, which must be addressed. <br /> First, there is the question of compliance with Subchapter 15 regulations. <br /> ( Title 23, California Administrative Code, Section 2510 and following) . These <br /> regulations include extensive requirements for discharges of waste to land, in <br /> order to protect water quality.
