Engineer <br /> DATE: 8 April 1986 SIGNATURE: <br /> SUBJECT: RENOWN SOIL/CALTRANS CROSS-TOWN FREEWAY <br /> The meeting today was attended by the people on the attached sign-up sheet. <br /> I opened the meeting by giving a brief history of the situation from the Board's <br /> perspective. I said that there had been a lack of communication between all <br /> parties, and that the information we had received up to now had been changing as <br /> time proceeded. I passed out our letter of 7 April 1986 which states our <br /> concerns and that we cannot grant an exemption to Subchapter 15 for Renown's oil <br /> contaminated soil to be used on the Stockton Cross-Town Freeway now. <br /> Tom Salata, of Brutoco, said that the material was not .that bad, and that they <br /> were ready to accept it now. <br /> Both Jim Jelinek and Dave Powers of Caltrans said that it was their firm policy <br /> that they do not accept materials for use in their projects for which they must <br /> have continued liability. <br /> Mr. Salata wanted us to grant an exemption so that Renown could do what they <br /> wanted with the material . I said that the exemption we would grant must be a <br /> site-specific exemption. I also said that Caltrans, no matter whether we <br /> granted an exemption or not, would retain liability. The basis of my remark was <br /> that the California Water Code provides for responsibility by the person who is <br /> discharging the waste. <br /> The meeting adjourned so that Mr. Salata and the Caltrans representatives could <br /> meet with Jerry Russell , the chief construction for Caltrans. He will have the <br /> final decision on acceptance of the waste. <br /> I said that I would not do anything unless I got a formal request to grant an <br /> exemption, other supporting information, and a statement from Caltrans that they <br /> will accept the material once an exemption is granted. <br /> DTW:jec <br /> Attachment <br />
