Memorandutr*
CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD . CENTRAL VALLEY REGION
3201 S S4pt Sacramento. California 95816 Phone: 445-0270
TO Antonia Vorster, Sr. Engineer FROM: Daniel Ward, Area Engineer
Lawrence Pearson, Sup. Engineer
DATE: 8 April 1986 SIGNATURE:
SUBJECT: RENOWN SOIL/CALTRANS CROSS-TOWN FREEWAY
The meeting today was attended by the people on the attached sign-up sheet.
I opened the meeting by giving a brief history of the situation from the Board's
perspective. I said that there had been a lack of communication between all
parties, and that the information we had received up to now had been changing as
time proceeded. I passed out our letter of 7 April 1986 which states our
concerns and that we cannot grant an exemption to Subchapter 15 for Renown's oil
contaminated soil to be used on the Stockton Cross-Town Freeway now.
Tom Salata, of Brutoco, said that the material was not .that bad, and that they
were ready to accept it now.
Both Jim Jelinek and Dave Powers of Caltrans said that it was their firm policy
that they do not accept materials for use in their projects for which they must
have continued liability.
Mr. Salata wanted us to grant an exemption so that Renown could do what they
wanted with the material . I said that the exemption we would grant must be a
site-specific exemption. I also said that Caltrans, no matter whether we
granted an exemption or not, would retain liability. The basis of my remark was
that the California Water Code provides for responsibility by the person who is
discharging the waste.
The meeting adjourned so that Mr. Salata and the Caltrans representatives could
meet with Jerry Russell , the chief construction for Caltrans. He will have the
final decision on acceptance of the waste.
I said that I would not do anything unless I got a formal request to grant an
exemption, other supporting information, and a statement from Caltrans that they
will accept the material once an exemption is granted.
DTW:jec
Attachment
