' 4 In lieu of providing proof of insurance pursuant City Council policy, CHEVRON agrees to maintain a self-administered claims program as described in Exhibit "C," attached and incorporated by reference 5 CHEVRON shall require all subcontractors to procure and keep in force during the term of this License bodily injury liability and property damage liability insurance adequate to protect CITY, its officers, agents and employees against any liability resulting from injury or death of any person or damage to property in connection with the area, operation or condition of the Property Such insurance shall be in the amount of $1,000,000 combined single limits for bodily injury or property damage The limit of such insurance shall not limit the 1`ability of CHEVRON All insurance hereunder shall be with companies to be approved by CITY Said policies shall name the City of Stockton as an additional insured by separate endorsement and shall insure against contingent liabilities, if any,-of CITY and officers,-agents and employees of CITY and shall obligate the insurance tamers to notify CITY in wasting, not less than thirty (30) days prior to the cancellation thereof, or as any other change affecting the coverage of the policies ` 6 In consideration of the Incense granted herem, CHEVRON shall conduct its environmental investigation and/or remediation as required by Iaw,'at its sole cost and expense 7 Upon termination, CHEVRON shall properly seal and abandon the monitoring well according to the then prevailing state or local requirements for such abandonment procedures and return the property to its original condition including return of the surrounding soil to its original grade and replacement of sod In the event CHEVRON fails to properly remove the monitoring well and restore the surrounding soil to its original condition upon notice from CITY, CITY shall have the right to take whatever actions are necessary to remove the well and restore the surrounding soil and CITY and CHEVRON agree that CITY shall recover such expenses from CHEVRON which CHEVRON shall pay promptly upon request i Page 2
