CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ADMINISTRATIVE CIVIL LIABILITY COMPLAINT R5-2015-0539 <br /> MANDATORY PENALTY <br /> IN THE MATTER OF <br /> MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT <br /> WASTEWATER TREATMENT PLANT <br /> SAN JOAQUIN COUNTY <br /> This Complaint is issued to the Mountain House Community Services District (hereafter Discharger) <br /> pursuant to California Water Code (Water Code) section 13385, which authorizes the imposition of <br /> Administrative Civil Liability, Water Code section 13323, which authorizes the Executive Officer to issue <br /> this Complaint, and Water Code section 7, which authorizes the delegation of the Executive Officer's <br /> authority to a deputy, in this case the Assistant Executive Officer. This Complaint is based on <br /> allegations that the Discharger violated provisions of Waste Discharge Requirements (WDRs) Orders <br /> R5-2007-0039, R5-2013-0004, and R5-2013-0004-01 (NPDES CA0084271). <br /> The Assistant Executive Officer of the Central Valley Regional Wastewater Quality Control Board <br /> (Central Valley Water Board or Board) alleges the following: <br /> 1. The Discharger owns and operates a wastewater collection, treatment and disposal system, and <br /> provides sewerage services, for the community of Mountain House. Treated municipal <br /> wastewater is discharged to Old River, a water of the United States and part of the Sacramento- <br /> San Joaquin Delta. <br /> 2. Discharges from the Facility were regulated by the Central Valley Water Board under WDRs <br /> Order R5-2007-0039, which was issued on 4 May 2007. On 31 January 2013, effective on 22 <br /> March 2013, the Board issued WDRs R5-2013-0004, which contained new requirements and <br /> rescinded WDRs Order R5-2007-0039, except for enforcement purposes. On 9 October 2014, <br /> Board issued WDRs Order R5-2013-0004-01 which amended WDRs Order R5-2013-0004 to <br /> include Delta Regional Monitoring Program requirements. <br /> 3. On 4 May 2007, the Central Valley Water Board issued Time Schedule Order (TSO) R5-2007- <br /> 0040, providing a time schedule until 30 April 2012 to comply with final effluent limitations for <br /> bis(2-ethylhexyl)phthalate, cyanide, group A pesticides (aldrin and heptachlor), and iron. On <br /> 2 February 2009, the Board issued TSO R5-2009-0013 and rescinded TSO R5-2007-0040, <br /> except for enforcement purposes. TSO R5-2009-0013 provided a time schedule until <br /> 30 August 2012 to comply with final effluent limitations for bis(2-ethylhexyl)phthalate, cyanide, <br /> group A pesticides (aldrin and heptachlor), iron, total trihalomethanes, dibromochloromethane, <br /> and dichlorobromomethane. <br /> 4. On 3 August 2012, the Board issued TSO R5-2012-0073 and rescinded TSO R5-2009-0013, <br /> except for enforcement purposes. TSO R5-2012-0073 provided a time schedule until <br /> 23 June 2017 to comply with final effluent limitation for dibromochloromethane and <br /> dichlorobromomethane. On 12 April 2013, the Board issued Order R5-2013-0037, which <br /> rescinded TSO R5-2012-0073, except for enforcement purposes. <br /> 5. On 31 January 2013, the Board issued TSO R5-2013-0005, which provided a time schedule until <br /> 1 February 2018 to comply with the new effluent limitation for temperature. <br />
