Local officers: released waste. <br /> Exist Ing law requires lite Department of Toxic Substances Control <br /> and any local health officer or a local public officer designated by ilio <br /> Direclor of Toxic Substances Control to enforce ilia standards and <br /> regulations concerning hazardous waste. <br /> EAlsting law allows a responsible pally for a hazardous materials <br /> releaSe Sita to Mabee ane request to Ilia Site Designation Committee, <br /> Which IS within the California Environmental Protection Agency,to <br /> designate an administering agency to oversee a site investigation and <br /> remedial action at that haZardoUS nrtaterials release site. <br /> This bill would authorize a party responsible for.the release of <br /> waste,as defined.to request that a local officer,as defined,supervise <br /> a remedial action, as defined, for the cleanup of that waste, tinder <br /> prescribed circumstances. The bill would require Ilial remedial <br /> actions be carried out pursuant to a remedial action agreement <br /> entered into by Ilia local off iter and ilia responsible party. This hill <br /> would specify like contents of Ilia rentedlal action agreetnqul, and <br /> would prescribe Ilia duties and responsibilities of the local officer <br /> Willi regard to ilia rantedial Mellon agreement. <br /> '1'lte bill would specify that It does 1101 apply to certain descrlbed <br /> ` hazardous substance release sites or hazardous waste facilities. <br /> 'Tito bill would atttharize local officers to charga responsible parties <br /> a fee to recover the reasonable and necessary costs incurred lit <br /> • supervising ilia remedial action. <br /> The people of the State of California do enact as follows: <br /> SECTION 1. Article 4.2 (commencing with Section 1512) Is added <br /> to Chaplet 1 of Part 2 of Division I of Ilse I lealth and Safety Code,to <br /> tend. <br />
