Bonham, Linden, California-Dorothy Sandberg. <br /> Dear Ms. Logorio: <br /> This letter is intended to correct an error in the document entitled"Case Closure Summary- <br /> Leaking Underground Fuel Storage Tank Program" and dated January 21, 1999. There are <br /> obviously no objections to the closure of the site. <br /> Section IV, entitled"Closure," contains an incorrect response to "List enforcement actions <br /> taken" as "NOR", which I am assuming is short for "None on Record." The query marked "List <br /> enforcement actions rescinded" contains no response. <br /> Significant enforcement actions were taken in this matter. Two separate actions were filed <br /> against Mrs. Sandberg for purported violation of various laws applicable to underground storage <br /> tanks, for nuisance and for purported "unfair and illegal business acts and practices." Both were <br /> referred to the District Attorney's Office of the County of San Joaquin by the PHS/EHD,and sought <br /> $500-$5,000 per day per tank penalties,etc., from Mrs. Sandberg,a seventy-year old woman. The <br /> cases were filed under Nos. CV 003797 and 294191. Since both cases were dismissed with <br /> prejudice there is no need to rescind the enforcement actions. <br /> Furthermore, on or about 5112198,Letitia Briggs of the PHS/EHD issued a"Notification of <br /> Hazardous Waste Discharge" pursuant to Health & Safety Code § 25180.7. This Notice is only <br /> appropriately issued when there has been an "illegal discharge or threatened illegal discharge of a <br /> hazardous waste"which the person"knows . . . is likely to cause substantial injury to the public <br /> health or safety." A copy is enclosed for your review. <br />
