Bonham, Linden, California-Dorothy Sandberg.
Dear Ms. Logorio:
This letter is intended to correct an error in the document entitled"Case Closure Summary-
Leaking Underground Fuel Storage Tank Program" and dated January 21, 1999. There are
obviously no objections to the closure of the site.
Section IV, entitled"Closure," contains an incorrect response to "List enforcement actions
taken" as "NOR", which I am assuming is short for "None on Record." The query marked "List
enforcement actions rescinded" contains no response.
Significant enforcement actions were taken in this matter. Two separate actions were filed
against Mrs. Sandberg for purported violation of various laws applicable to underground storage
tanks, for nuisance and for purported "unfair and illegal business acts and practices." Both were
referred to the District Attorney's Office of the County of San Joaquin by the PHS/EHD,and sought
$500-$5,000 per day per tank penalties, etc., from Mrs. Sandberg,a seventy-year old woman. The
cases were filed under Nos. CV 003797 and 294191. Since both cases were dismissed with
prejudice there is no need to rescind the enforcement actions.
Furthermore, on or about 5112198,Letitia Briggs of the PHS/EHD issued a"Notification of
Hazardous Waste Discharge" pursuant to Health & Safety Code § 25180.7. This Notice is only
appropriately issued when there has been an "illegal discharge or threatened illegal discharge of a
hazardous waste"which the person"knows . . . is likely to cause substantial injury to the public
health or safety." A copy is enclosed for your review.
