FROM: REGINA M BOYLE FAM NO. : 209 52480tl i 06-e1-98 12:19P P.06
l into the Tanks, and that t utput openings were paved ovcr'at sotrtne prior to November of I965.
2 3. I have never used the Tanks, and no cine else ,hm used the Tanks at any time or for any
3 purpose during the time period in I have been the owner of the Property, beginning in Feb,i: ry of
4 1976. Furthermore, I have not observed, or been directly ori directly informed of any use being made
5 of the Tanks at any time, including specifically since the time I first visited the Property in November
6 of 1965.
7 4_ I had at some point been told that a gas station had been operated on the Property at
8 some tune between the 1950's and 1960'x, but I have no persona]knowledge that this was in fact true.
9 S_ I first saw the Prdperty some time in the month of November of 1965_ At that time
i
14 there was no gas station on the property, no advert`tsistg signs for such, and no.pump islands. In
11 addition, the output openings from the Tanks had already been paved over, and only two plates which
12 appeared to be manhole covers were visable. If the Tanks had in fact ever been used in the past, they
13 were no longer usable as of November of 1965_ The t" were paved over some time prior to
14 November of 1965, except for two metal-plate-covered input openings. The output pumps and
15 associated piping had been disconnected prior to that time as well (if such everwas in fact connected
15 in the first place). It is dear in kind sigh# that these Tanks had been rendered inoperable and
17 abandoned at some unknown time prior to November of 1965.
,r
1$ 6. My farmer husband, Harry Sandberg, has been a tenant on the Property since
19 approximately May of 1966 up to the pmeznt time, and since the Tanks are located tinder what is now
20 the parking lot for the Property, he would have observed ifany use were made of the Tanks.
21 7. On or about rune 19, 1991, I was provided with a copy of the PHSIEHD policy
22 applicable to tanks abandoned prior to July 1, 1984, attd was!informed that this policy was applicable
23 to me and that I needed to comply with it. The policy specifically states that tanks like mine which
24 . were abandoned prior to JWy 1, 1984,were not required to comply with the statutory closure standards
25 and requirements, yet the PHSIEHD has consistently demanded that I "properly close" the Tanks, !
26 which I understand to mean that they are attempting to reguue me to comply with a statute that they
27 have told nae does not apply to me. A true and Correct copiy of the PHSIEHD Policy and the letter
28 which accompanied.it is attached hereto as Exhibit".A"
- 2 - 0002
