Bonhan-, Linden, California <br /> Dear Mr. Wilson and Ms. Logario: �; r <br /> I am an attorney for Mrs. Dorothy Sandberg who is the property owner for the above- <br /> described commercial realty. As you may be aware, the San Joaquin,County Public Health Service <br /> is a party to a Settlement Agreement relating to the above-described property. The express terms <br /> of paragraph 3 of this Agreement require that "[t]he PHS will act in good faith to expedite the <br /> issuance of such closure permits, to approve tank removal wA plans for the closure of the Tanks, <br /> and to expedite the final closure of the Tanks." Paragraph 3 goes on to require that "[t]he PHS shall <br /> at all times act in good faith with respect to monitoring the closure of the Tanks, and the remediation <br /> of contamination, if any, which may be determined to exist in connection with the Tanks." <br /> We wish to acknowledge;and to thank you for the extraordinary expediency with which you <br /> have both issued the permits and approved the work plans provided�in connection with the closure <br /> of the tanks. $ <br /> We wish also to express some concerns which have aFnsen from Mr. Wilson's letter dated <br /> May 14, 1998. That letter stated that "[b]ased on the level ofcontaminants present in the samples <br /> jcollected,further investigation to determine the extent of the soil and/or groundwater contamination <br /> is required."
