At that time the property was owned by Louise and John DeMartini and was leased to the Signal Oil Company. Successor in Interest to SIGNAL OIL COMPANY 575 Market Street San Francisco, California 94105 We also wish to express concern regarding Mr. Wilson's statement in his May 14th letter that "[t]he appropriate disclosure of a hazardous waste discharge pursuant to Section 25180.7 of the HSC has been made". This section only requires a notification of"the illegal discharge or threatened illegal discharge of a hazardous waste within the geographical area of his jurisdiction and who knows that such discharge or threatened discharge is likely to cause substantial injury to the public health or safety".' We are not aware of any "illegal discharge or threatened discharge" and we are aware of no evidence that there has been any threat of a discharge"likely to cause substantial injury to the public health or safety." We must therefore ask that you provide us with the basis for your report. In light of the completion of the additional investigation requested by the local agency, and the positive test results we would ask that you fulfill the remaining requirements of the Settlement Agreement and provide Mrs. Sandberg with a letter indicating that no further action will be required.
